ANALISIS KASUS PENIPUAN ONLINE DITINJAU DARI UNDANG-UNDANG NOMOR 11 TAHUN 2008 TENTANG INFORMASI DAN TRANSAKSI ELEKTRONIK

Penipuan adalah salah satu kasus yang sering terjadi di lingkungan masyarakat.Dengan berbagai motif dan cara untuk melakukan kejahatan ini sudah berkembang seiring kemajuan zaman.Kemajuan zaman membawa efek pengaruh positif maupun negatif terhadap kehidupan bermasyarakat.Bentuk dari kemajuan zaman dengan ditandai banyaknya terobosan dalam dunia teknologi dan informasi.Namun,penggunaan kemajuan ini banyak digunakan untuk melakukan kejahatan,seperti adanya praktik penipuan online.Kasus penipuan online marak terjadi pada saat melakukan aktivitas jual-beli barang di online.Hal ini harus menjadi perhatian bersama antara masyarakat dan pemerintah untuk bersama menghadapi fenomena penipuan online ini.Aturan yang mengatur kasus penipuan online sudah termuat dalam Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik ( ITE).Dengan adamya aturan ini diharapkan bisa mengatasi praktik penipuan online dan menindak pelaku kejahatan ini dengan tegas dan adil di wilayah Negara Kesatuan Republik Indonesia ( NKRI).

ABSTRACT

Fraud is one of the cases that often occurs in society. With various motives and methods for committing this crime, it has developed along with the progress of the times. The progress of the times has had both positive and negative effects on social life. and information. However, the use of this progress is often used to commit crimes, such as the practice of online fraud. Cases of online fraud are rampant when carrying out activities of buying and selling goods online. This must be a joint concern between the community and the government to jointly face the phenomenon this online fraud. The rules governing online fraud cases are contained in Law Number 11 of 2008 concerning Information and Electronic Transactions (ITE). With the existence of these regulations it is hoped that they can overcome the practice of online fraud and take action against the perpetrators of this crime firmly and fairly in the region.
