PENGATURAN PRAKTEK MEDIASI TERHADAP UPAYA PENYELESAIAN PERSELISIHAN HUBUNGAN INDUSTRIAL DI INDONESIA

ABSTRAK
Perselisihan hubungan industrial sering kali memicu konflik antara pekerja/serikat pekerja/serikat buruh dengan pengusaha sehingga memerlukan cara atau formula penyelesaian sengketa diantara keduanya yang dapat mengayomi dan memberikan solusi yang dapat diterima oleh para pihak. Dalam Undang-undang Nomor 2 Tahun 2004 tentang Penyelesaian Perselisihan Hubungan Industrial mengatur penyelesaian perselisihan hubungan industrial mensyaratkan mekanisme penyelesaian perselisihan hubungan industrial didasari musyawarah untuk mufakat dengan mengedepankan mekanisme bipartite dan mediasi sebagai prasyarat utama sebelum masuk ke dalam mekanisme Peradilan Hubungan Industrial.

ABSTRACT
An industrial relations dispute often lead to conflict between employees/unions/ labor unions with employers that require dispute resolution method or formula between them to protect and provide a solution that is acceptable to the parties. In Law Number 2 a tender in 2004 for the settlement of the Industrial Dispute organize a labor dispute resolution requires a labor dispute resolution mechanism based on deliberation by promoting bipartite mechanisms and mediation as a main prerequisite prior to entry into the judicial mechanisms of industrial relations.
